{"id":5941,"date":"2022-05-20T10:11:41","date_gmt":"2022-05-20T17:11:41","guid":{"rendered":"https:\/\/biddle.com\/blog\/?p=5941"},"modified":"2022-05-20T10:11:43","modified_gmt":"2022-05-20T17:11:43","slug":"ofccp-publishes-new-2022-audit-list","status":"publish","type":"post","link":"https:\/\/biddle.com\/blog\/2022\/05\/20\/ofccp-publishes-new-2022-audit-list\/","title":{"rendered":"OFCCP Publishes New 2022 Audit List"},"content":{"rendered":"\n<p>The OFCCP has once again quietly <a href=\"https:\/\/www.dol.gov\/agencies\/ofccp\/foia\/library\/corporate-scheduling-announcement-lists\">published<\/a> a new \u201cCorporate Scheduling Announcement List,\u201d or \u201cCSAL,\u201d as they are known. The CSAL is a list of federal contractor establishments that have been selected, but not yet scheduled for a compliance evaluation.<\/p>\n\n\n\n<p>The list appeared with no fanfare as the OFCCP seems to have fallen out of the habit of letting the public know about important developments (or any, really, other than settlement wins for the agency). The new list appeared on the OFCCP\u2019s website briefly yesterday but was quickly taken down.<\/p>\n\n\n\n<p>Typically one or two audit lists are generated each year through the OFCCP\u2019s \u201c<a href=\"https:\/\/www.dol.gov\/agencies\/ofccp\/faqs\/scheduling-lists\">administratively neutral selection<\/a>\u201d process in order to keep the work pipeline flowing for agency compliance officers. Note that being listed on a CSAL does not guarantee that your selected location will actually be audited in the same year that the CSAL was published, or the next year for that matter. It simply means that the location\u2019s bingo ball has been pulled from the hopper and the OFCCP will get to it eventually.<\/p>\n\n\n\n<p>And the OFCCP has abandoned the tradition of treating the CSAL list as any sort of meaningful \u201cheads-up\u201d to contractors about impending audits. In the past, the agency implemented various informal policies by which actual audit letters from a newly generated list would not be sent for a set period of time after the list was published. The OFCCP recently announced in an <a href=\"https:\/\/www.dol.gov\/agencies\/ofccp\/directives\/2022-02\">agency directive<\/a>, however, that some audit letters from the new list might go out immediately.<\/p>\n\n\n\n<p><strong>What\u2019s In the List?<\/strong><\/p>\n\n\n\n<p>There are 400 federal contractor establishments or functions newly selected for audit. 12 of those will be \u201cCorporate Management Compliance Evaluations\u201d (CMCEs). These are typically audits of the organization\u2019s headquarters location (or U.S. headquarters) that, in addition to a \u201cregular\u201d audit, focuses on potential \u201cglass ceiling\u201d issues and the particulars of hiring, managing, and compensating upper management.<\/p>\n\n\n\n<p>12 of the entries are tagged as \u201cFAAP\u201d audits, meaning that the contractors selected hold current \u201cfunctional affirmative action plan\u201d agreements (FAAPs) with the OFCCP and the agency has selected a function, rather than a physical location, to audit. There do not appear to be any construction audits included in the new list.<\/p>\n\n\n\n<p>Consistent with the OFCCP\u2019s most recent <a href=\"https:\/\/biddle.com\/blog\/2022\/04\/07\/ofccp-signals-much-tougher-stance-in-new-directives\/\">directive<\/a>, the remainder of the audits on the new list will be \u201cfull\u201d establishment reviews, as the agency has shelved the \u201cfocused\u201d reviews implemented during the prior administration. Although the agency has not been explicit on the matter, BCGi anticipates that this means the more detailed procedures for the more limited focused reviews will not be abandoned, but rather rolled into the procedures for a \u201cregular\u201d audit, making the standard audit experience far more involved. The agency has these detailed audit procedures for focusing on disability issues, veteran issues, promotions, and compensation (though the last two were never implemented).<\/p>\n\n\n\n<p><strong>Where Can I Find the List?<\/strong><\/p>\n\n\n\n<p>The OFCCP now publishes all CSALs on a dedicated web page <a href=\"https:\/\/www.dol.gov\/agencies\/ofccp\/foia\/library\/corporate-scheduling-announcement-lists\">here<\/a>. The page can also be accessed from the OFCCP\u2019s \u201cFOIA Library\u201d page <a href=\"https:\/\/www.dol.gov\/agencies\/ofccp\/foia\/library\">here<\/a>, which is chock full of other interesting information as well.<\/p>\n\n\n\n<p><strong>What Should I Do?<\/strong><\/p>\n\n\n\n<p>Nothing, according to the OFCCP. As far as the agency is concerned, your AAPs should always be \u201caudit ready,\u201d so getting an audit letter in the mail should not result in panic.
