Clearing up Confusion on VETS-4212 Extension

September 22, 2017 By Jeff Davies, M.A.

When the filing deadline for VETS-4212 reports was extended to November 15, 2017 last week, several outlets began to spread the word.  Unfortunately, a number of these articles and statements had conflicting information regarding who can benefit from the filing extension.  While some reported that only federal contractors directly affected by Hurricanes Harvey and Irma could use the extension, other outlets reported that all contractors were eligible.  The flip-flopping information caused confusion as recently as yesterday.

After numerous correspondence with the VETS Office, Biddle can confirm that the notification is intended to provide coverage for all federal contractors, not only those in certain areas of Texas, Louisiana, and Florida.  Any federal contractor may file their VETS-4212 reports by November 15 this year without penalty.

While the deadline for filing technically remains at September 30th as in other years, the notification creates a “safe harbor” extension period.  Below is a copy of the announcement.

NOTICE: Impact from Hurricanes Harvey and Irma

NOTICE: In order to accommodate the needs of those impacted by Hurricanes Harvey and Irma, Federal contractors who file their VETS-4212 Reports by November 15, 2017 will not be cited for failure to file a timely Report or failure to comply with Federal regulations.

Federal contractors are required to annually file VETS-4212 forms in compliance with 38 U.S. Code, Section 4212, and 41 CFR Section 61-300. Additional assistance for VETS-4212 filing questions is available on the FAQ webpage.  Inquiries may also be made via email at vets4212-customersupport@dol.gov or by phone at (866)237-0275.
